Assumption of Risk

I understand that renting and operating heavy equipment, machinery, or power tools at or through [Your Business Name] involves inherent risks that cannot be eliminated regardless of the care taken to avoid injury, including but not limited to: rollover, tip-over, or crush injuries; entanglement in moving parts, blades, or augers; hydraulic or mechanical failures; falls while mounting or dismounting equipment; contact with buried or overhead utilities; flying debris; and hearing damage from prolonged noise exposure. I understand these risks may result in personal injury, illness, permanent disability, death, or property damage. I voluntarily choose to proceed with full knowledge of these risks, on my own behalf and on behalf of any minors listed below.

Release of Liability and Indemnification

In consideration of being permitted to participate or rent, I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless [Your Business Name], its owners, officers, employees, agents, and landlords from any and all claims, demands, causes of action, and costs (including attorney's fees) arising out of or related to any loss, damage, or injury sustained while participating in the activity, using rented equipment or property, or while on the premises, whether arising from the ordinary negligence of [Your Business Name] or otherwise, to the fullest extent permitted by law.

Rules and Safety Instructions

I agree to follow all posted rules and all verbal or written instructions given by staff, including: operating equipment only if trained and authorized, using seatbelts and rollover protection where equipped, keeping bystanders clear of the work area, calling utility-locate services before any digging, no operation while impaired or fatigued, and following the manufacturer's operating manual at all times. I understand that failure to follow rules or instructions may result in removal from the premises or termination of the rental without refund, and that I am responsible for any damage I cause through misuse of equipment, property, or facilities.

Operator Qualification & Training

I represent that I am qualified to operate the rented equipment, that I hold any license or certification required by law for its operation, and that I received and understood the operating orientation provided by [Your Business Name]. I agree that only operators meeting these requirements will use the equipment during the rental period.

Equipment Condition & Damage Responsibility

I acknowledge inspecting the equipment and accepting it in good working condition. I accept responsibility for loss, theft, or damage to the equipment during the rental period as described in my rental agreement, agree to stop use immediately and notify [Your Business Name] if the equipment malfunctions, and agree not to attempt repairs or modifications myself.

Severability and Governing Law
