Boat & Jet Ski Rental Liability Waiver

Assumption of Risk

I understand that renting and operating a boat or personal watercraft at or through [Your Business Name] involves inherent risks that cannot be eliminated regardless of the care taken to avoid injury, including but not limited to: drowning; collisions with other vessels, swimmers, docks, or submerged objects; propeller injuries; falls overboard or within the vessel; changing weather, waves, and water conditions; carbon monoxide exposure near engines; and fuel or fire hazards. I understand these risks may result in personal injury, illness, permanent disability, death, or property damage. I voluntarily choose to proceed with full knowledge of these risks, on my own behalf and on behalf of any minors listed below.

Release of Liability and Indemnification

In consideration of being permitted to participate or rent, I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless [Your Business Name], its owners, officers, employees, agents, and landlords from any and all claims, demands, causes of action, and costs (including attorney's fees) arising out of or related to any loss, damage, or injury sustained while participating in the activity, using rented equipment or property, or while on the premises, whether arising from the ordinary negligence of [Your Business Name] or otherwise, to the fullest extent permitted by law.

Medical Authorization

I represent that I (and any minors listed below) am in good health and have no condition that would make participation unsafe. Rules and Safety Instructions

I agree to follow all posted rules and all verbal or written instructions given by staff, including: wearing U.S. Coast Guard–approved life jackets as required, carrying required safety equipment, no operation while impaired (boating under the influence is a crime), observing no-wake zones and posted waterway rules, staying within the permitted operating area, and returning before the agreed time or at staff recall for weather. I understand that failure to follow rules or instructions may result in removal from the premises or termination of the rental without refund, and that I am responsible for any damage I cause through misuse of equipment, property, or facilities.

Operator Qualification

I represent that I meet the minimum age to operate the rented vessel, hold any boater education card or license required by the state where I will operate it, and received and understood the vessel orientation and local waterway briefing provided by [Your Business Name].

Vessel Condition & Damage Responsibility

I acknowledge inspecting the vessel and accepting it in good condition. I accept responsibility during the rental period for damage to the hull, engine, or propeller — including damage from grounding, debris strikes, or improper beaching — and for towing or recovery costs, as described in my rental agreement.

Severability and Governing Law
