ATV & Off-Road Rental Liability Waiver

Assumption of Risk

I understand that renting and operating an ATV, UTV, or off-road vehicle at or through [Your Business Name] involves inherent risks that cannot be eliminated regardless of the care taken to avoid injury, including but not limited to: rollovers and ejection; collisions with vehicles, trees, rocks, or terrain features; loss of control on loose, steep, or uneven surfaces; being struck by branches or debris; reduced visibility from dust; pinch and burn injuries from machine components; and serious injury or death — off-road vehicles are powerful machines that demand constant attention. I understand these risks may result in personal injury, illness, permanent disability, death, or property damage. I voluntarily choose to proceed with full knowledge of these risks, on my own behalf and on behalf of any minors listed below.

Release of Liability and Indemnification

In consideration of being permitted to participate or rent, I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless [Your Business Name], its owners, officers, employees, agents, and landlords from any and all claims, demands, causes of action, and costs (including attorney's fees) arising out of or related to any loss, damage, or injury sustained while participating in the activity, using rented equipment or property, or while on the premises, whether arising from the ordinary negligence of [Your Business Name] or otherwise, to the fullest extent permitted by law.

Medical Authorization

I represent that I (and any minors listed below) am in good health and have no condition that would make participation unsafe. Rules and Safety Instructions

I agree to follow all posted rules and all verbal or written instructions given by staff, including: wearing a helmet, eye protection, and closed-toe shoes at all times, riding only on approved trails or areas, observing posted speed limits, no passengers on single-rider machines, meeting age and size requirements for the machine ridden, and no operation while impaired. I understand that failure to follow rules or instructions may result in removal from the premises or termination of the rental without refund, and that I am responsible for any damage I cause through misuse of equipment, property, or facilities.

Safety Gear & Rider Orientation

I acknowledge receiving a rider orientation covering the machine's controls, terrain, and rules, and being offered a helmet and safety gear. I agree that I (and any minors listed below) will wear required safety gear at all times while riding, and that riders will ride within their ability and the limits set by [Your Business Name].

Machine Condition & Damage Responsibility

I acknowledge inspecting the machine and accepting it in good condition. I accept responsibility during the rental period for damage to or loss of the machine and its components, and for recovery costs if it becomes stuck or disabled through misuse, as described in my rental agreement.

Severability and Governing Law
